Trademark Renewals

By sharing basic information about your trademark and uploading samples, Law 4 Small Business will handle the task of renewing your Trademark for you.

More specifically, all US-based trademarks are required to file a renewal with the USPTO, depending on the status of the trademark. First-time renewals require what’s called a Section 8 Declaration of Use between years 5 and 6, after issuance of a registration number. Subsequent to that, trademark owners must file a Section 9 Renewal every ten (10) years after issuance of a registration number.

After the 5th year of receiving a registration number for your trademark, you are permitted to file what’s called a Section 15 Affidavit of Incontestability. For this reason, it is advised to file your Section 15 at the same time you file your Section 8. Conveying incontestability status provides some significant legal advantages in the strength of your trademark.

• This service is provided for only one (1) trademark, for a Section 8 Declaration of Use and/or Section 15 Incontestability, or Section 8 Declaration of Use and Section 9 Renewal. No additional filings or assistance is provided.
• This service covers up to the submission of the correct forms. It does not cover any work that may be needed after the filing, including but not limited to responses to Office Actions (i.e. the USPTO rejects your specimens for the Section 8 Declaration of Use).
• This does not include Excusable Non-Use options. We can help, but we need to handle this in a different manner.
